Terms and Conditions

§ 1 Scope

(1) The following General Terms and Conditions (hereinafter referred to as “GTC”) apply in their current version to all contracts concluded between us, AWP Freiburg, Arbeitsgemeinschaft für wissenschaftliche Psychotherapie Freiburg, Salzstraße 20, 79098 Freiburg and you as our customer via our website accessible at www.awp-freiburg.de (hereinafter referred to as “booking platform”).
(2) These General Terms and Conditions regulate the legally binding booking of courses and seminars (hereinafter “AWP courses”) via the booking platform operated by us. With regard to the content and nature of the offer as well as further details on the AWP courses, reference is made to the description on the booking platform and to the information provided during the booking process.
(3) This booking platform and the AWP courses are intended as professional training measures exclusively for entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). Entrepreneurs are understood to be natural or legal persons or partnerships with legal capacity who, when concluding a legal transaction, act in the exercise of their commercial or independent professional activity. This also includes all persons who use AWP courses as professional training measures. In derogation from this, a customer is considered a consumer within the meaning of Section 13 of the German Civil Code (BGB) if and to the extent that the purpose of their order cannot be predominantly attributed to commercial or independent professional activity. Consumers are generally excluded from using our offers.
(4) All agreements made between you and us in connection with the conclusion of the contract arise in particular from these General Terms and Conditions and our written booking confirmation. We do not accept any deviating conditions from the customer. This also applies if we do not expressly object to their inclusion. Individual agreements made with you in individual cases always take precedence over our General Terms and Conditions.

§ 2 Conclusion of contract

(1) The presentation and advertising of the AWP courses on our booking platform do not constitute a binding offer to conclude a contract. The contract is concluded exclusively in electronic commerce via our booking platform and through our acceptance. The ordering process for concluding the contract on our booking platform includes the following steps: o Selection of the offer/AWP course o Entry of personal data and billing address o Clicking the button “Register now for a fee” o Confirmation email, automated registration confirmation
(2) By submitting an order via the booking platform by clicking on the button “Register now for a fee”, you are making a legally binding booking. If and to the extent that a course is already fully booked, you will have the opportunity to place yourself on a waiting list without obligation, which you can revoke at any time.
(3) A contract is concluded when you click on the button “Register now for a fee” or, alternatively, by sending the invoice (hereinafter: “Invoice”). You will receive a registration confirmation by email immediately after your booking.
(4) The contract language is German. The contract text will be stored by us. We will send you the order data and our general terms and conditions in text form immediately after the contract has been concluded.

§ 3 Course booking and cancellation conditions

The seminar leader named in the program can be replaced by an equally qualified leader. The type of course implementation (face-to-face and/or online event) may change due to the current corona situation. Courses are booked online and are binding. After receipt of your booking, an invoice will be issued. Please pay your invoice to the specified account within 10 days of receipt of the invoice. Cancellations will only be accepted in writing and will be confirmed by us. The following cancellation fees apply regardless of the reasons: – if you cancel up to 4 weeks before the start of the course: € 30.00 – if you cancel 4 weeks or more before the start of the course: € 60.00 – if you cancel 7 working days or more before the start of the course or if you do not show up without written cancellation, the entire course fee will be retained. Course fees already paid will be offset against the cancellation fees. Rebooking a course Rebooking is only possible if you register at least two weeks before the start of the course and there are still places available for the replacement date or course. We will charge you a rebooking fee of €20 for this. Cancelling a course package If a cancellation is unavoidable, the following cancellation fees will apply regardless of the reasons: – if you cancel up to 4 weeks before the start of the course package: €40 – if you cancel 4 weeks or more before the start of the course package: €60 If you cancel 7 working days or more before the start of the course or if you do not show up without written cancellation, the entire course price for the first course will be retained without a price reduction. If individual courses from the course package are cancelled, the course package fee will not be refunded pro rata. Rebooking the entire course package Rebooking the entire course package is only possible if the course package is offered again at a different time. The rebooking must be notified in writing (by post or email) at least two weeks before the start of the course package. Instead of the cancellation fee, a rebooking fee of €60 will apply. Once we have received your re-registration, we will send you an invoice for the rebooking fee. Rebooking individual courses from the course package Rebooking individual courses is not possible within the course package.

§ 4 Prices and shipping costs

(1) All prices stated on our booking platform are final prices. The courses we offer are exempt from sales tax. The total price you pay is calculated based on the number of AWP courses booked. The final price is displayed in the booking form before you submit the booking.
(2) There are no shipping costs, as we send the booking confirmation and your confirmation of participation in the AWP courses primarily electronically to the email address you provided.

§ 5 Terms of payment

(1) Please transfer your course and other fees after receiving the invoice, at the latest within 10 days, stating your name, the course number and the invoice number to the following account: – For DBT, APT, CFT, SuP, DBT-PTBS, VT, EFT and MBT-

§ 6 Liability

(1) We shall be liable to you in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of wasted expenses.
(2) In other cases, we shall only be liable – unless otherwise provided for in Section 6 Paragraph 3 – in the event of a breach of a contractual obligation, the fulfilment of which is essential for the proper execution of the contract and on whose compliance you as a customer may regularly rely (so-called cardinal obligation), and shall be limited to compensation for foreseeable and typical damage. In all other cases, our liability is excluded, subject to the provisions in Paragraph 3.
(3) Our liability for damages resulting from injury to life, body or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

§ 7 Cancellation of AWP courses

(1) For organizational or other reasons, it may be necessary in individual cases to change an announced trainer, the type of course held (face-to-face and/or online event), cancel or postpone the AWP courses you have booked. This applies in particular if the number of participants does not cover costs, if speakers are unavailable at short notice, if there is force majeure or other objectively justified reasons for which AWP is not directly responsible. In these cases, we therefore reserve the right to cancel the agreed appointment at short notice or to postpone it in consultation with you. If no new appointment is made, we will fully refund all payments you have made.
(2) Further claims against us, such as claims for damages (travel costs, overnight stay, etc.) are excluded in the event of cancellation or postponement of an AWP course for the reasons stated in paragraph (1) or the repayment of the purchase price, unless there is gross negligence. The provisions under # § 6 of these terms and conditions remain unaffected. If an event cannot be held due to a low number of participants or illness of a trainer, the cancellation will take place at least one week before the start of the course. In this case, the participation fee will be refunded in full. We recommend that you take out travel cancellation insurance when booking your arrival and departure as well as your accommodation.

§ 8 Data protection

In connection with the initiation, conclusion, processing and reversal of a contract based on these terms and conditions, we collect, store and process the personal data you provide. This is done within the framework of the statutory provisions and in compliance with data protection requirements. We do not pass on any of your personal data to third parties unless we are legally obliged or authorized to do so or you have previously expressly consented to such a transfer. If and to the extent that a third party is used for services in connection with the handling of processing procedures (such as payment service providers), the provisions of the Federal Data Protection Act and other data protection regulations are strictly adhered to. The data you provide when placing an order is processed exclusively for the purpose of establishing contact within the framework of contract processing and only for the purpose for which you made the data available. If we are subject to retention periods of a commercial or tax law nature, the storage of some data can last up to ten years. At your request, personal data will be deleted, corrected or blocked within the framework of the statutory provisions. You can obtain information about all your stored personal data free of charge. § 9 Protection rights

The contents of our booking platform as well as the required and used software are subject to protective rights and legal regulations for the protection of intellectual property.

§ 10 Information on applicable law and place of jurisdiction

(1) This contract is governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods and excluding references. However, the choice of law shall not apply to the extent that a consumer within the meaning of Section 1 Paragraph 3 of these Terms and Conditions would be deprived of the protection afforded to him by those provisions from which no deviation by agreement may be permitted under the mandatory law of the state in which he as a consumer has his habitual residence.
(2) If you, as the contractual partner, are a merchant, a legal entity under public law or a special fund under public law and are domiciled in Germany at the time of the order, the exclusive place of jurisdiction for all claims arising from the contract is Freiburg.
